But the creditor nonetheless chose to attempt to secure a personal deficiency judgment. Using skilled drafting, clear oral arguments and unbending tenacity over the course of approximately 18 months, Dan’s advocacy compelled the court to rule that the creditor had waived its right to a deficiency judgment by virtue of its full credit bid, thereby saving our clients from additional debt of about $350,000.
